11.2 Ad hoc Committee of Experts on Buildings (CAHB) - terms of reference and call for candidatures

Action – Item proposed for adoption without debate

To adopt the revised terms of reference of the Ad hoc Committee of Experts on Buildings (CAHB) and to open the call for candidatures for the appointment of members for a three-year term from 1 April 2021 to 31 March 2024.

1.         The Rapporteur Group on Programme, Budget and Administration (GR-PBA) agreed to recommend that the Deputies adopt the revised terms of reference of the Ad hoc Committee of Experts on Buildings (CAHB) as they appear in Appendix 1 without further debate.

2.         The term of office of the current members of the Ad hoc Committee of Experts on Buildings (CAHB) will end on 31 March 2021. The Committee of Ministers is therefore required to make new appointments to the CAHB for the three-year period from 1 April 2021 to 31 March 2024.

3.         As laid down in Articles 4 and 5 of its revised terms of reference, the CAHB is composed of 11 independent experts from member States and provides opinions on the technical and financial aspects of the construction, conversion and upkeep of the Organisation's buildings.

4.         A member and alternate member shall be appointed upon nomination by the governments of each of the five major contributor member States to the general budget for the Organisation. The six other members and their alternate members are to be appointed upon nomination by the governments of other member States. Alternate members are appointed in respect of each State whose candidate is appointed a titular member insofar as the States concerned nominate candidates for alternate members.


5.         The members of the CAHB serve for terms of three years, renewable. The current membership is as follows:[2]

6.         Candidatures should be deposited with the Secretariat of the Committee of Ministers of the Council of Europe before 12 noon on 9 November 2020. The Deputies will be invited to make the appointments at their 1391st meeting (9 December 2020). Detailed information on the call for candidatures is set out in Appendix 2 to these notes.

DRAFT DECISIONS

The Deputies

1.         adopted the revised terms of reference of the Ad Hoc Committee of Experts on Buildings (CAHB) set out in document CM(2020)86;

2.         invited member States to submit, by 9 November 2020 at 12 noon, candidatures of experts[3] who are trained architects or engineers and/or have experience in real estate management for appointment to the Ad hoc Committee of Experts on Buildings (CAHB), for a three-year term of office beginning on 1 April 2021.


Appendix 1: Committee of Experts on Buildings (CAHB) – Terms of reference[4]

4.         Terms of reference:

(i) To provide, at the request of the Committee of Ministers or of the Secretariat, opinions on the technical and financial aspects of the construction, conversion and upkeep of the Organisation's buildings;

(ii) To report to the Committee of Ministers;

(iii) In pursuit of its terms of reference, the committee shall work in close conjunction with the Secretariat and shall meet as necessary.

5.         Membership of the committee:

(i) The Committee of Ministers shall appoint eleven independent experts, including one expert from the host country, on proposals from the member States.

An expert shall be appointed upon nomination by the governments of each of the major contributor member States to the General Budget for the Organisation.

The remaining experts shall be appointed upon nomination by the governments of the other member States.

Eleven alternate members shall be appointed by the Committee of Ministers, under the same conditions, in respect of each State whose candidate is appointed titular member.

(ii) The travel and subsistence expenses of the experts appointed shall be borne by the Council of Europe budget; they shall not be remunerated.

(iii) Other experts may take part in the committee's work, at their governments' expense.

(iv) All the experts must be trained architects or engineers and/or have experience in real-estate management.

6.         Structure and working methods:

(i) The committee shall elect a chairperson and a vice-chairperson.

The election of the chairperson and the vice-chairperson shall require a two-thirds majority of appointed members for the first round and a simple majority for the second round. The election shall be by show of hands unless a member of the Committee requests a secret ballot.

(ii) The term of office of the chairperson and the vice-chairperson shall be one year, renewable once.

Only experts appointed by the Committee of Ministers shall be entitled to vote.

(iii) With the consent of the Committee of Experts, the Secretariat may, if necessary, invite a person with particular expertise in a subject on the agenda to attend committee meetings in an advisory capacity.

7.         Duration:

The term of office of the Committee experts shall be three years, renewable.

The duration of the Committee is indefinite.

Appendix 2: Information on the call for candidatures[5] for appointment of members and alternate members of the Ad hoc Committee of Experts on Buildings (CAHB) of the Council of Europe

Function: 11 members and 11 alternate members of the Ad hoc Committee of Experts on Buildings (CAHB) of the Council of Europe.

Required qualifications: trained architects or engineers and/or experience in real-estate management (Article 5 (iv) of the terms of reference).

Nationality:the 11 members must be nationals of different member States. The 11 alternate members shall be appointed in respect of each State whose candidate is appointed member.

1st Group: 5 members and their alternates to be appointed upon nomination by the governments of the major contributors (France, Germany, Italy, Russian Federation, United Kingdom).

2nd Group: 6 members and their alternates to be appointed upon nomination by the governments of the other member States.

Term of office: three years, renewable (Article 7 of the terms of reference). The term of office shall begin on 1 April 2021.

Working languages: the official languages of the Council of Europe are English and French.

Meetings:each meeting lasts between 1 and 3 days, according to the workload.

Allowances: the reimbursement of travel and subsistence expenses of the members of the CAHB is subject to the Council of Europe rules. The daily allowance has been set for each meeting day at €175 for 2020 (50% for hotel accommodation, 15% for each main meal and 20% for miscellaneous expenses). Travel expenses are reimbursed under certain conditions. The members of the CAHB receive no remuneration.

Department/authority responsible for receiving candidatures: the Secretariat of the Committee of Ministers of the Council of Europe.

Deadline for receipt of candidatures: candidatures must reach the Secretariat of the Committee of Ministers by 9 November 2020 at 12 noon (Central European Time: CET) at the latest.

Gender balance: Recommendation Rec(81)6 on the participation of women and men in an equitable proportion in committees and other bodies set up in the Council of Europe should be borne in mind when submitting candidates.

The admissibility deadline for candidatures for posts or functions open to all member States or to several of them to be filled by means of elections in the Committee of Ministers must be strictly complied with.

The deadline is deemed to have been met if the date on which the candidature was received at the Council of Europe, as attested by the stamp of the responsible department, is on, or before, the date of the stipulated deadline.

The candidature may also reach the Council of Europe, by electronic mail to the Secretariat of the Committee of Ministers ([email protected]). In this case, the date of the electronic mail will constitute a sufficient indication of compliance with the deadline. The Secretariat will provide the sender with an electronic receipt for the mail concerned. However, the original of the letter of candidature will have to reach the Council of Europe as soon as possible, and, at all events, prior to the holding of the election.

Any member State is at liberty to replace a candidature already submitted with another, prior to expiry of the deadline.


Nevertheless, the Committee of Ministers may decide, by a majority as provided by Article 20 (b) of the Statute, to prolong the deadline for receipt of candidatures in the case where a member State wishes to replace a candidature which has reached the Council of Europe by the stipulated deadline with another candidature after expiry of the deadline, provided that the State in question can put forward objective reasons for forgoing the initial candidature (death, illness, change to another function incompatible with the duties of the function concerned … ). The prolongation of the deadline would apply to all member States invited to submit candidatures.

[2] The current composition reflects the number of experts from six major contributor member States and eight from other member States. The revised terms of reference propose inter alia to return the number of experts on the CAHB to its former composition (pre-2016) following Turkey’s discontinuation as a major contributor to the budgets of the Council of Europe.
